Update on NRA-NY AG Interventions by Frank Tait and Rocky Marshall
The fight to reform the NRA continues
The main event is the intervention filed by then sitting NRA Director, Rocky Marshall. Originally we thought that there would be a hearing on October 12, but that is not accurate. As I understand from our attorneys, “the Oct. 12 date is just arbitrary. New York has this archaic system based in the early 1900s I suppose, where someone who files a motion just picks a date at least 15 days out to have it come up before a judge. But these are almost always rescheduled, so picking that day is really just a way to get it on the court's calendar.
The actual schedule for Rocky's motion is that opposing briefs are due October 18, with our reply due October 27, and then the judge will set a hearing date at some point after that. Most likely mid-November but he can set it whenever he wants, there's no real time limit.”
On the Tait-Aguirre intervention that the Judge denied back in September, on Friday, October 8, our attorneys filed motions for reargument. The motion is on the NYAG site at document number 400. The motions basically state that “Judge, We disagree with your decision, and here’s why it was wrong”. We asked for another oral argument, but the Judge doesn’t have to allow that - he may or may not order the opposition to file a response. We are in a wait-and-see with this motion.

For the third year, I am running for the NRA Board as a petition candidate. This year I need 477 signatures of voting members (Life members or 5 consecutive year members) to get on the ballot.
