As you might have heard, we were trying to get an NRA Director added to the Intervention that Mario Aguirre and I led. We were not able to get that done in time for the Judge to consider that in his ruling.
However, as of Friday, September 24, NRA Director-Rocky Marshall filed his Intervention with the NY court! The details of the filing are here NY NRA Docket starting with docket number 376 and going through 390.
One of the keys here is that since Rocky is a sitting NRA Director, and this action was filed under 720(b)(1) even if the Director later loses his seat, the action is still valid. This has never been overruled.
This action got national press attention with articles in the NY Post and the Wall Street Journal (Paywall). It also got a formal response from NY AG Leticia James.

Rocky is asking the court to remove LaPierre and Frazer and the entire board and to appoint him as a Temporary Receiver to create a new board. “Therefore it will do no good to merely remove the Defendants LaPierre and Frazer because this would leave the same passive Board in place that has allowed the misconduct that brought the NRA to where it is today. Only a new and independent NRA Board elected by the membership and free from Defendant LaPierre’s influence and control can effectively hire new executive leadership to oversee the NRA’s rehabilitation.”
There is still no clarity as to where Rocky Marshall and I stand as write-in candidates from the 2021 election. The elections committee is meeting this Friday and we will hear where we stand at the Annual Members meeting on Saturday.
I will be at the NRA Members’ meeting and the NRA Board meeting on Saturday. GIven this filing, these meetings should be entertaining. I’ll have further updates after the meeting.
